
There are two common instances in which estate administration takes place. The first is where a person becomes incapacitated or incapable and his or her attorney(s) under a power of attorney look after the person's property. The other is where a person dies and his or her executor(s) and trustee(s) administer that person's estate.
I often act for donors of powers of attorney, for attorneys, and for executors and trustees. In some instances, when I have been appointed under a power of attorney, I act as an attorney, and when I have been appointed under a will, I act as an executor and trustee.
It is of the utmost importance that attorneys, executors and trustees act in accordance with the power or will under which they were appointed. Instructions must be scrupulously adhered to, any discretion must be appropriately exercised, and full and complete records kept. It is not only the property itself that must be protected. Attorneys, executors and trustees must also be protected in the responsibilities they assume and the actions they take.
Estates are a major part of my practice, and I give guidance to many attorneys, executors and trustees. When appropropriate, I am also prepared to be appointed an attorney or an executor and trustee.
